1. Acceptance of these terms
By accessing this website or using the SEAES HMS software, you agree to these Terms of Use. If you do not agree, please do not use the service. A specific hospital deployment is also governed by the signed agreement between SEAES and that hospital; where that agreement and these terms differ, the signed agreement controls.
2. What SEAES HMS is
SEAES HMS is a hospital management system that helps a hospital run registration, consultations, pharmacy, laboratory, wards, theatre, ICU and billing. It is a tool used by trained staff. SEAES does not practise medicine and does not make clinical decisions; responsibility for patient care, diagnoses and prescriptions rests with the hospital and its clinicians.
3. Accounts & acceptable use
If you are given access, you are responsible for keeping your login credentials confidential and for activity under your account. You agree to provide accurate information and to use the service only for lawful, authorised purposes within your hospital's policies.
4. Prohibited conduct
You must not:
- use the service unlawfully or to infringe anyone's rights;
- attempt to gain unauthorised access, interfere with, or disrupt the service or its security;
- scrape, copy or reverse-engineer the software except as the law expressly permits;
- misuse patient data or breach applicable privacy and medical-records law.
5. Intellectual property
The SEAES HMS software, this website, and their content, design and trademarks are owned by SEAES or its licensors and are protected by law. You are granted a limited right to use the service as licensed; no other rights are transferred. Open-source components are used under their respective licences.
6. Data protection
Our handling of personal information is described in our Privacy Policy, which forms part of these terms. For patient data, the hospital is the Data Fiduciary and SEAES acts as a Data Processor.
7. Third-party services & integrations
SEAES HMS can connect to third-party services (for example payment, SMS, WhatsApp, accounting export and ABDM). Your use of those services is subject to their own terms; we are not responsible for their availability or conduct.
8. Disclaimers
The service is provided on an “as is” and “as available” basis. To the extent permitted by law, SEAES disclaims implied warranties and does not warrant that the service will be uninterrupted or error-free. Nothing in the service is medical advice; it does not replace professional clinical judgement.
9. Limitation of liability
To the maximum extent permitted by Indian law, SEAES is not liable for indirect, incidental or consequential losses arising from use of the service. Nothing in these terms excludes liability that cannot lawfully be excluded.
10. Indemnity
You agree to indemnify SEAES against claims arising from your misuse of the service or your breach of these terms or applicable law.
11. Changes & termination
We may update, suspend or discontinue parts of the service, and may update these terms; the “Last updated” date reflects the current version. We may suspend access for breach of these terms.
12. Governing law & disputes
These terms are governed by the laws of India. The courts at Pune, Maharashtra have jurisdiction, subject to any dispute-resolution mechanism set out in a hospital's signed agreement with SEAES.
